Before this Court is an application under Section 439 Cr.P.C. preferred on behalf of petitioner Rajvinder Singh, who has been arrested in FIR No.80/2021 of Police Station Hathipol, District Udaipur for the offences punishable under Sections 17, 17(A), 17 (B), 27 (B) (1), 27 (c), 27 (D) of Drugs and Cosmetic Act, Section 53, 57 of Disaster Management Act and Section 420, 120-B of IPC.

Learned counsel for the petitioner submits that co-accused Subham and Pankaj have been enlarged on bail by the co-ordinate benches of this Court and the case of the present petitioner is not different from the case of the said co-accused. It is therefore prayed that petitioner-accused may be enlarged on bail.

Learned Public Prosecutor opposed the grant of bail application.

Having considered rival contentions of the learned counsel for the parties and material available on record, without commenting on the merits of the case, this Court deem it just and proper to enlarge accused-petitioner on bail under Section 439 Cr.P.C.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner Ratanlal s/o Chotu Ram shall be released on bail in connection with FIR No.80/2021 of Police Station Hathipol, District Udaipur provided he executes a personal bond in the sum of Rs.1,00,000/- with two sound and solvent sureties of Rs.50,000/- each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
