Before this Court is an application under Section 439 Cr.P.C. preferred on behalf of petitioner Ram Lal, who has been arrested in connection with FIR No. 129/2020, Police Station Sadar Bhilwara, District Bhilwara for the offence punishable under Sections 302, 365 & 120-B IPC.
Learned counsel for the petitioner submits that the prosecution witnesses have not supported the prosecution story in their statements recorded under Section 161 Cr.P.C. They have categorically stated that they did not see who caused the injuries to the deceased. Witnesses Netu & Raja Ram have also not averred anything against the petitioner. In further investigation they have produced the affidavit in favour of petitioner. It is prayed that petitioner may be enlarged on bail.

Learned Public Prosecutor opposes the grant of bail to the petitioner. Learned counsel for the complainant does not dispute for grant of bail.
Having considered rival contentions of the learned counsel for the parties and material available on record, without expressing any opinion on merits of the case and in the facts and circumstances of the case this Court deems it just and proper to enlarge the accused-petitioner on bail under Section 439 Cr.P.C.
Accordingly, this bail application under Section 439 Cr.P.C. is allowed and it is ordered that the petitioner Ram Lal S/o Heera Lal shall be released on bail in connection with FIR No. 129/2020, Police Station Sadar Bhilwara, District Bhilwara, provided he executes a personal bond in the sum of Rs. 1,00,000/- (rupees One Lakh) with two sound & solvent sureties of Rs. 50,000/(rupees Fifty Thousand) each to the satisfaction of learned trial court for his appearance before that court on each & every date of hearing and whenever called upon to do so.
