This application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with F.I.R. No.866/2019 registered at Police Station Muhana, District Jaipur City (South) for the offence(s) under Section(s) 420, 467, 468, 471 & 120-B IPC.

It is contended by learned counsel for the petitioner that he has falsely been implicated in this case wherein there is no allegation of commission of cheating on the basis of alleged power of attorney. He submitted that FIR contains allegation against the petitioner and co-accused Vinod Singh of forging the power of attorney and Vinod Singh has already been extended benefit of pre-arrest bail by this Court and case of the petitioner is not distinguishable from his case. already joined the investigation in pursuance of direction of this Court and his custodial interrogation is not warranted. He, therefore, prayed for release of the petitioner on pre-arrest bail.

Although, learned Public Prosecutor assisted by Mr. Kalyan Prasad, Investigating Officer submitted that custodial interrogation of the petitioner is warranted; but, could not dispute that the case of the petitioner is at parity with that of co-accused Vinod Singh who has already been extended benefit of pre-arrest bail by this Court.

Taking into consideration the submissions advanced by the learned counsels for the respective parties, the nature of allegation against the petitioner, the contents of the case diary, the factum of joining the investigation, cooperation therein and especially release of co-accused Vinod Singh having similar allegation on pre-arrest bail by this Court; but, without expressing any opinion on the merits of the case, this Court deems it just and proper to enlarge the petitioner on anticipatory bail under Section 438 Cr.P.C.

Accordingly, the bail application is allowed and it is directed that in the event of arrest of petitioner in connection with aforementioned FIR registered at concerned Police Station the petitioner Datar Singh S/o Shri Rajendra Singh Shekhawat shall be released on bail; provided he furnishes a personal bond in the sum of ₹1,00,000/- (Rupees One Lac only) together with two sureties in the sum of ₹50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the concerned Investigating Officer/S.H.O. on the following conditions :-

(i). that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii). that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer; and

(iii). that the petitioner shall not leave India without previous permission of the court.
