The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.638/2012 registered at Police Station J.D.A., District Jaipur Cityfor the offence(s) under Section(s) 420, 406, 467, 468 & 471 I.P.C. and later on for the offence under Sections 420, 406, 467, 468, 471 & 120-B I.P.C.

Learned counsel for the petitioner submitted that the petitioner is not named in the FIR nor, it contains any allegation against him. He submits that the petitioner is aged about 65 years and is in custody for last about two months. He, therefore, prayed for release of the petitioner on bail.

Learned Public Prosecutor opposing the bail application

submitted that there are grave and serious allegation against the petitioner of duping not only the complainant but other persons also. He submitted that the investigation is still pending and the petitioner has criminal antecedents also, therefore, the petitioner does not deserve indulgence of bail.

Taking into consideration the submissions advanced by learned counsels for the respective parties, the nature and gravity of allegations against the petitioner, his criminal antecedents and especially investigation being pending; but, without expressing any opinion on the merits of the case, this Court is not inclined to enlarge the petitioner on bail.

The bail application is dismissed accordingly.
