The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.437/2020 registered at Police Station khairthal, Police District Bhiwadi, District Alwar (Rajasthan) for the offence under Section(s) 420, 406 & 120-B of IPC.

Learned counsel for the petitioner submitted that in another bail application No.14506/2020 arising out of FIR No. 119/2018 registered at Police Station khairthal, District Alwar (Rajasthan) against him containing similar allegations, this Court has been pleased to extend him benefit of bail on the condition of deposit of the amount paid by the complainant and prays for similar order in the instant case also.

Learned Public Prosecutor has opposed the bail application.

Learned counsel for the complainant submitted that he has no objection if the petitioner is extended benefit of bail on similar terms as were imposed by this Court vide order dated 18.01.2021 in S.B. CRLMP No.14506/2020.

Heard the learned counsels for the parties and perused the record as well as the order dated 18.01.2021 in S.B. CRLMP No.14506/2020.

Taking into consideration the submissions advanced by learned counsel for the petitioner and the fact that the petitioner shall deposit a demand draft worth Rs.5,10,000/- drawn in favor of complainant with the Court concerned which shall be handed over to the complainant by the Court; but, without expressing any opinion on the merits of the case, this court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application is allowed subject to aforesaid and it is directed that accused-petitioner Khammaram S/o Bheraram shall be released on bail under Section 439 Cr.P.C. in connection with afore-mentioned FIR registered at concerned Police Station, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial court with the stipulation that he shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
