In wake of onslaught of COVID-19, abundant caution is being taken while hearing the matters in Court.
This Court perused the material available on record.
The petitioners have been arrested in connection with FIR No.62/2020 of Police Station Kuwariya, District Rajsamand for the offences punishable under Sections 447, 323, 325, 307/34 IPC. They have preferred this bail application under Section 439 Cr.P.C.
Learned counsel for the petitioners submits that charge sheet in this case has already been filed.
This Court, on perusal of the statement of the injured witness Jagdish Bagaria, finds that the sole blow of axe, which has

caused the injury in the head of the injured witness, has been attributed to Ratanlal.
Learned Public Prosecutor opposed the bail application.
After arguing for some time at this stage, learned counsel for the petitioners submits that he does not press the bail application of petitioner No.1-Ratanlal at this stage and only seeks bail for petitioner No.2-Narayan.
Looking into the peculiar facts and circumstances of the case, this Court is inclined to grant bail to the petitioner No.2Narayan. However, the bail qua petitioner No.1-Ratanlal stands dismissed as not pressed.
Accordingly, this bail application filed under Section 439 Cr.P.C. qua petitioner No.1-Ratanlal is dismissed as not pressed at this stage. However, this bail application under Section 439 Cr.P.C. qua petitioner No.2-Narayan is allowed and it is directed that petitioner No.2 Narayan S/o Shri Harji shall be released on bail in connection with FIR No.62/2020 of Police Station Kuwariya, District Rajsamand provided he executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.
