In wake of onslaught of COVID-19, abundant caution is being taken while hearing the matters in Court.

Heard learned counsel for the parties and perused the material available on record.

The petitioner has been arrested in connection with CR case No.97/2020 of Police Station Deedwana (Nagaur) for the offence punishable under Sections 498A, 323, 307, 120-B of IPC. He has preferred this second bail application under Section 439 Cr.P.C.

Learned counsel for the petitioner has shown the statement of the father of the victim in which the father has said that he does not want to take the belongings of his daughter because after she is healthy, she along with her children will go back and live with the present petitioner. Learned counsel for the petitioner

submits that such high expectations of the girl’s family to live with the petitioner is indicative of the larger picture of the family arrangement being positive. Learned counsel for the petitioner has further demonstrated from the medical report that the injuries caused were simple in nature. Learned counsel for the petitioner submits that the fact of administration of poison is not supported by any scientific or medical evidence. Learned counsel for the petitioner submits that the charge-sheet has already been filed in this case and the petitioner is in custody since 16.07.2020.

Learned Public Prosecutor vehemently opposes the bail application on the ground that the hypertensive bleeding occurred to the lady and she had to remain hospitalized for long. Learned Public Prosecutor also submits that such kind of aggravated matrimonial violence has to be seriously deprecated.

After hearing learned counsel for the parties and perusing the medical report wherein all injuries have been pointed out to be simple in nature and looking into the fact that the petitioner is in custody since 16.07.2020 and the charge-sheet has already been filed in this case, this Court is inclined to grant bail to the accused petitioner under Section 439 Cr.P.C.

Accordingly, this second bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner Ranjeet Khan @ Master S/o Shri Ajam Khan shall be released on bail in connection with CR case No.97/2020 of Police Station Deedwana (Nagaur) provided he executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/each to the satisfaction of learned trial court for his appearance
