The present bail application has been filed under Section 439 Cr.P.C.

Learned counsel for the petitioner submitted that the complainant admittedly purchased the plot Nos.163 & 168 from the present petitioner.

Learned counsel submitted that the complainant has specifically levelled allegation against the co-accused Avinash Saini for demanding Rs.2,00,000/- as bribe to him.

Learned counsel for the petitioner further submitted that the petitioner was nowhere in a position to demand the money from the complainant to show off favour to him.

Learned counsel further submitted that the other co-accused Avinash Saini has already been enlarged on bail by Coordinate Bench of this Court while accepting S.B.Criminal Misc. Bail

Learned Public Prosecutor has opposed the bail application.

This Court, considering the nature of allegation against the petitioner and grant of bail to the other co-accused Avinash Saini by the Coordinate Bench of this Court and without expressing any opinion on the merits of the case, deems it just and proper to release the petitioner on bail.

Accordingly, the present bail application filed under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Surgyan Saini S/o Shri Gopal Saini , shall be released on bail in connection with FIR No.341/2021 registered at Police Station Pradhan Aarkshi Kendra, Anti Corruption Bureau, Jaipur for the offences under Section 7A of the Prevention of Corruption (Amendment) Act, 2018 and Section 384, 120-B IPC, provided he furnishes a personal bond in the sum of Rs.50,000/- with one surety of alike amount to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
