The present bail application has been filed under Section 439 Cr.P.C.

Learned counsel for the petitioner submitted that the petitioner has been falsely implicated in the present case for committing offences under Sections 302, 396, 120-B and 412 IPC.

Learned counsel for the petitioner submitted that the petitioner was a driver of the vehicle-Pickup, which is said to be used in commission of the crime.

Learned counsel for the petitioner submitted that the Police during investigation has not found any specific role of the petitioner in commission of crime i.e. death of Nanchi Lal.

Learned counsel for the petitioner further submitted that the Police after investigation has already filed final report and the petitioner is in custody for more than three months.

Learned counsel appearing on behalf of the complainant submitted that the petitioner was a part of conspiracy, hatched by all the accused to commit the crime.

Learned counsel submitted that the accused petitioner was well aware about the plan of the other co-accused to commit the crime and as such the petitioner has rightly been made an accused by the Police.

Learned Public Prosecutor has opposed the bail application and submitted that role assigned to the present petitioner, implicate him in commission of crime as he said to be present only about 500 Meters away from the site of commission of crime.

I have heard the submissions made by learned counsel for the parties and perused the material available on record.

This Court finds that the petitioner is said to be only driver of the vehicle-Pickup and Police has already conducted the investigation and filed final report, and without expressing any opinion on the merits of the case, deems it just and proper to release the petitioner on bail.

Accordingly, the present bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner Kamlesh Meena S/o Harinarayan Meena , shall be released on bail in connection with FIR No.0432/2021 registered at Police Station Sanganer Sadar, District Jaipur provided he furnishes a personal bond in the sum of Rs.50,000/- with one surety of alike amount to the satisfaction of the learned trial Judge for his
