The present anticipatory bail application has been filed under Section 438 Cr.P.C. in connection with FIR No.158/2021 registered at Police Station Mathuragate, Bharatpur for the offence(s) under Sections 420, 406, 120B, 504 of IPC.

Counsel for the petitioners submits that the petitioners have been falsely implicated in this case. Petitioners have joined the investigation as per direction of this Court. Learned counsel for the petitioners also submits that complainant has taken full and final settlement by taking amount of Rs.2,81,000/- on 31.08.2020. The case pertains to civil nature and criminal colour has been given to it. So, the petitioners be enlarged on anticipatory bail.

Learned Public Prosecutor as well as learned counsel for the complainant have opposed the anticipatory bail application and submit that till today, Rs.1,62,000/- is due between the parties. So, the bail application be dismissed.

Considering the contentions put-forth by the counsel for the petitioners and taking into account the facts and circumstances of the case and without expressing any opinion on the merits of the case, this court deems it just and proper to allow the anticipatory bail application.

Accordingly, the anticipatory bail application is allowed. The S.H.O/I.O/Arresting Officer, Police Station Mathuragate, Bharatpur in FIR No.158/2021 is directed that in the event of arrest of the petitioners Mahendra Singh S/o Patram , Rajveer Singh @ Vp Singh S/o Mahendra Singh and Vikram Singh S/o Mahendra Singh they shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioners shall make themselves available for interrogation by a police officer as and when required;

(ii) that the petitioners shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such facts to the court or any police officer, and

(iii) that the petitioners shall not leave India without previous permission of the court.
