The present second bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioner, who is in judicial custody in connection with F.I.R. No. 144/2021, Police Station Hanumangarh Town, District Hanumangarh, registered for the offences under Sections 395 & 412 of IPC.

Heard and considered the arguments advanced by the learned counsel for the petitioner and learned Public Prosecutor. Perused the material available on record.

Learned counsel for the petitioner stated that first bail application of the accused-petitioner was rejected vide order dated 26.07.2021; subsequently benefit of bail was granted by learned trial Court to co-accused persons, namely, Subhash vide order dated 28.07.2021 and Bheemsen vide order dated 31.07.2021; benefit of bail has already been granted by co-ordinate bench of

this Court to co-accused Sandeep Soni vide order dated 07.05.2021. Learned counsel further stated that second bail of accused-petitioner was filed before learned trial Court but the same was rejected on the ground that bail application of other coaccused was rejected by this Court; accused-petitioner is a bank manager and he was taken on gun point; charge-sheet has been filed for the offence under Section 395 IPC; accused-petitioner is behind the bars since 20.03.2021 and trial will take time. With these submissions, learned counsel for the petitioner prayed that the benefit of bail may be granted to the accused-petitioner.

Per contra, learned Public Prosecutor has opposed the bail application and stated that money and ornaments were recovered from the accused-petitioner.

In reply, learned counsel for the petitioner stated that gold were also recovered from co-accused Pawan, Subhash, Sonu Kumar, Dipti Kumar @ Anmol and Madan Lal.

Having regard to the facts and circumstances of the case, particularly to the fact that benefit of bail was granted by learned trial Court to co-accused persons, namely, Subhash vide order dated 28.07.2021 and Bheemsen vide order dated 31.07.2021; benefit of bail has already been granted by co-ordinate bench of this Court to co-accused Sandeep Soni vide order dated 07.05.2021; charge-sheet has been filed and trial will take sufficiently long time, therefore, without expressing any opinion on the merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.

Consequently, the bail application is allowed. It is ordered that the accused-petitioner Sanjay Singh S/o Late Sayar Singh, arrested in connection with F.I.R. No. 144/2021, Police Station Hanumangarh Town, District Hanumangarh, shall be released on bail, if not wanted in any other case; provided he furnishes a personal bond of Rs.50,000/- and two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
