Complainant-petitioner has filed this bail cancellation application under Section 439(2) of Cr.P.C.

F.I.R. No. 220/2017 was registered at Police Station Ramgarh Pachwara District Dausa for offence under Section 304-B of I.P.C.

It is contended by counsel for the complainant-petitioner that bail was granted on the condition that the accusedrespondent was not in the country for last 24 years, whereas, from the call location, his presence was near the place of occurrence.

Counsel for the accused-respondent has opposed the bail

cancellation application. It is contended that bail was granted way back on 15.03.2018. A period of three years has lapsed. It is also contended that accused-respondent is not the husband of the deceased.
