This revision petition has been filed by the petitioner aggrieved against the order dated 23.2.2012 passed by the District Judge, Jodhpur District, whereby, the application filed by the petitioner under Order VII Rule 10 and Order XIV Rule 2 CPC has been rejected.
Learned counsel for the petitioner submits that the trial court while dismissing the application has observed that the issue with regard to the aspects raised would be decided during course of the trial of the suit and, therefore, the petitioner may be permitted to

withdraw the revision petition with liberty to agitate the issues before the trial court.
In view of the submissions made, the revision petition is dismissed as withdrawn with liberty as aforesaid.
