Learned counsel appearing for the appellant fairly submits that appellant intends to challenge the order dated 22.06.2020 of the Arbitrator deciding the application filed under Section 17 of the Arbitration and Conciliation Act, 1996 (hereinafter referred to as ‘the Act of 1996’) by way of filing appeal under Section 37 of the Act of 1996.

Learned counsel for the appellant further submits that proper remedy will be availed by the appellant, however, the interim protection granted by this Court on 27.07.2020, may be continued at least for one week or till the application for interim relief is decided by the Appellate Forum as provided under Section 37 of the Act of 1996.

Learned Senior Counsel-Mr. Kamlakar Sharma appearing for the respondents submits that the respondents have no objection if the appellant intends to withdraw the present appeals, however, the interim protection may not be granted to the appellant as the present appeals filed under Section 37 of the Act of 1996, are not maintainable and in fact appellant at first instance itself should have filed the appeal before the Appropriate Forum.

Learned Senior Counsel for the respondents further submits that once this Court does not have jurisdiction to entertain the

present appeals, the continuation of interim order will not be within four corners of the law.

I have heard the submissions made by learned counsel for the parties.

This Court permits the learned counsel for the appellant to withdraw the present appeals with liberty to the appellant to approach the Appropriate Forum provided under the law and further if the law permits to move appropriate application for interim relief, the appellant can always avail the same.

Accordingly, the present appeals are dismissed as withdrawn with liberty as prayed for.

A copy of this order be separately placed in connected matter.
