This application for suspension of sentence has been filed by the petitioner along with the Criminal Revision Petition to suspend the sentence awarded by Chief Metropolitan Magistrate (Economic Offences), Jaipur Metropolitan vide judgment dated 21.02.2018 in Criminal Case No. 14/2015 and confirmed by Additional Session Judge No.9, Jaipur Metropolitan vide judgment dated 13.11.2019 in Criminal Appeal No. 27/2018.

Counsel for the petitioner submits that there is no evidence connecting the accuse-petitioner with the alleged offence under Section 132(1)(b) and 135 (1)(a) of the customs Act. The statement recorded under Section 108 of the Custom Act do not

connect the accused-petitioner with the alleged offence. The trial Court has imposed a sentence of 3 years imprisonment. During trial and during pendency of appeal before the appellate Court the accused-petitioner was on bail. It was also submitted that there are serious issues are involved in this petition, which will take time and hearing of the petition will take time. In support of the contention counsel for the petitioner placed reliance upon the order passed by this Court in S.B. Criminal Misc. Bail Application for Suspension of Sentence NO.631/2016.

Per contra, counsel for the respondent (Union of India) has opposed the application

Having heard the learned counsel for the parties and carefully scanned the entire material available on record, without expressing any opinion on the merits and demerits of the case, this application for suspension of sentence is allowed. It is ordered that the sentence awarded to the petitioner Indrajeet Singh S/o Shri Darshan Singh , by the trial court/appellate court shall remain suspended during pendency of the Revision Petition, provided he furnishes a personal bond of Rs. 50,000/(Rupees Fifty Thousand) together with two sureties of Rs. 25,000/- (Rupees Twenty Five Thousand) each to the satisfaction of learned trial court with the stipulation that he shall appear before this Court on 4.3.2020 and thereafter, as and when called upon to do so.
