This application for suspension of sentence has been filed by the petitioner along with the Criminal Revision Petition to suspend the sentence awarded by The Ld. Additional Chief Judicial Magistrate, Jhunjhunu (Raj.) vide judgment dated 31.05.2016 in Criminal Case No. 325/2012 (08/09) and confirmed by The Ld. Session Judge, Jhunjhunu (Raj.) vide order/judgment dated 14.10.2016 in Criminal Appeal No. 45/2016.

It is submitted that no offence under Section 138 N.I. Act is made out against the accused-petitioner. It was also submitted that the petitioner is ready and willing to abide by all conditions that may be imposed by this Court. He has already handed over a demand draft of Rs.50,000/- to the counsel for the complainant. Hence, sentence awarded by the Court below be suspended during the pendency of the revision petition.

Learned Public Prosecutor opposed the application however he admitted that Rs.50,000/- has already paid by the petitioner to the counsel for the complainant through demand draft, copy of which has been placed on record.

Having heard the learned counsel for the parties and carefully scanned the entire material available on record, but without expressing any opinion on the merits and demerits of the case, this application for suspension of sentence is allowed. It is ordered that the sentence awarded to the petitioner Yusuf Qureshi S/o Sule Mohammad , by the trial court/appellate court shall remain suspended during the pendency of this Revision Petition, provided the petitioner furnishes a personal bond of Rs. 50,000/- (Rupees Fifty Thousand) together with two sureties of Rs. 25,000/- (Rupees Twenty Five Thousand) each to the satisfaction of learned trial court with the stipulation that he shall appear before this Court on 4.3.2020 and thereafter, as and when called upon to do so.
