Heard Mr. Anupam Sharma, learned counsel for petitioner on through Video Calling as well as learned Public Prosecutor, who is present in the court and perused the judgments passed by the courts below.

This suspension of sentence application has been filed by the petitioner alongwith the petition.

Counsel for the petitioner has annexed the certificate under Rule 311 (3) of the Rajasthan High Court Rules to the effect that during the trial, the petitioner was on bail and sentence of two years under Sections 457 and 380 of I.P.C. each has been

awarded to the petitioner by the learned Trial Court. Counsel further submits that hearing of the petition may take long time, hence, the sentence awarded to the petitioner may be suspended during the pendency of the petition.

Learned Public Prosecutor has opposed the application for suspension of sentence.

Having perused the judgments and considering the facts and circumstance of the present case, this criminal misc. suspension of sentence application is allowed and it is ordered that execution of sentence awarded to the petitioner shall remain suspended during the pendency of the criminal revision petition and the petitioner be admitted to bail subject to satisfaction of the trial Court with the stipulation on the condition that the sentence shall remain suspended subject to deposit the fine imposed by the trial court, he shall appear before this Court on 04.08.2020 and thereafter as and when called upon to do so. Office is directed to send a copy of this order to the concerned trial Court through e-mail/fax, for necessary compliance.
