Learned AAG appearing for the State submits that this matter is covered by the judgment rendered by this Court in State of Rajasthan & Anr. vs. Rajkumari & Ors. [D.B. Special Appeal (Writ) No.1507/2019, decided on 20.12.2019] wherein following judgment has been passed:
“This intra-court appeal is directed against the order dated 03.11.2018 passed by learned Single Judge in SBCWP No.16333/2018, whereby writ petition preferred by the respondent No.1 herein, has been

allowed in terms of decision dated 14.11.2017 passed by a Coordinate Bench in SBCWP No.11862/2017 Samleta Vs. State of Rajasthan & Ors.
Learned counsel appearing for the appellants submits that special appeal preferred by the State against the judgment dated 14.11.2017 passed in the case of Samleta (supra), has already been dismissed by a Bench of this Court while upholding the judgment passed by learned Single Judge and, therefore, the present appeal also deserves to be dismissed in the light of Bench decision dated 11.10.2018 passed in DBSAW No.736/2018- State of Rajasthan & Ors. Vs. Semlata.
Accordingly, the instant special appeal is dismissed in the light of judgment dated 11.10.2018 passed by Coordinate Bench of this Court in Samleta’s case (supra).”
In terms of the aforesaid judgment, the present appeal is dismissed. All pending applications are disposed of accordingly.
