On 23.07.2020, the following order was passed by this Court.

“ Mr. Yuvraj Singh, learned counsel appearing for respondent – Union of India, submits that petitioner’s papers relating to family pension could not be processed, as death certificate dated 10.04.2018, produced by her, is in the name of “Gamanda Ram”; whereas name of the deceased employee was “Gamada Ram”.

He submits that it is because of this discrepancy, that respondents are not in a position to process petitioner’s case for family pension.

At the oral request of Mr. Rajdeep, District Statistics Officer and Gram Sewak, Village Jajiwal

Khinchiya are impleaded as party and Mr. Sunil Beniwal, AAG is directed to accept notice on their behalf.

Since the matter relates to petitioner’s family pension, such concerned authorities are directed to issue and endorse corrected/amended certificate within a period of 10 days from placing a certified copy of the order instant.

The petitioner may approach concerned authorities along with requisite documents, who shall forthwith issue amended or fresh certificate in the correct name.

List this case on 10.08.2020.”

Learned counsel for the petitioner submits that in compliance

of above order, an amended death certificate has been issued by the competent authority, a copy whereof has been provided to Mr. Yuvraj Singh, learned counsel for the respondents.

The instant writ petition is, thus, disposed of with the direction to the respondents to consider petitioner’s pension case, in accordance with law, preferably within a period of two months from today.

Needless to observe that if any of petitioner’s grievance still survives, she would be free to avail appropriate remedies, including filing of fresh writ petition.

Stay petition also stands disposed of accordingly.
