In the seniority list of Cattle Guards as on 31.5.1995, the name of the petitioner was mentioned at S.No.3 and his date of birth was shown as 3.4.1949. The petitioner has stated that while working as Cattle Guard and posted at Nursery, Mangali, he lodged a complaint against Ranger and Forester wherein allegations were levelled of their involvement in theft of trees from the Nursery. A departmental enquiry was initiated against both the persons and the Assistant Conservator (Forest), Bundi, was appointed as Enquiry Officer to conduct the enquiry. It is submitted that out of vengeance, the petitioner was asked to appear before the Medical Board at General Hospital, Bundi, where the Medical Jurist opined his age as more than 50 years or less than 55 years after conducting the ossification test. The doctor further opined that the age of the petitioner may be around 52-53 years. The said medical report was not served upon the petitioner and was relied upon while retiring the petitioner from the services.
