The petitioner by way of this petition assails the order dated 25.2.2020 whereby notice has been given to him imposing penalty on account of electricity theft alleged to have been committed by him.

Learned counsel for the petitioner submits that there was no theft committed and the petitioner is ready to deposit the excess amount of electricity used by him by depositing the sum of Rs.5 lacs for the period of four months. Learned counsel for the petitioner submits that the petitioner has already submitted a representation before the Settlement Committee but no action has

been taken. Thereafter, the petitioner has filed the present writ petition.

This court however finds that from the documents which are on record there is no proof to show that the petitioner has approached the settlement committee or filed any appeal against the notice. While allowing the petitioner to approach the Appellate Forum of the Ajmer Vidyut Vitran Nigam Limited, this writ petition is dismissed, at this stage, on account of the efficacious alternate remedy available with the petitioner. If the petitioner files an appeal before the Appellate Forum, it is expected that the same shall be decided within a period of 7 days from the date of filing the same.

With the aforesaid observation, this writ petition is dismissed.
