Since, these three bail applications filed under Section 439 Cr.P.C. arise out of the common FIR No.147/2019 Registered at Police Station Pilani, District Jhunjhunu for the offence(s) under Sections 147, 148, 149, 341, 323, 325, 307, 341, 323, 325, 395 & 427 of I.P.C., hence they have been heard together and are being decided by the present order.

Counsel for the petitioners submits that the petitioners have been falsely implicated in this matter. Counsel further submits that none of the injuries sustained by the injured is dangerous to life. Counsel further submits that the co-accused-Sonu@mohit has already been released on bail by the Coordinate Bench of this Court vide order dated 08.11.2019 passed in S.B. Criminal Misc. Bail Application No.15359/2019 and the petitioners are behind the bars for more than two months. Counsel further submits that the challan has already been presented in the court and conclusion of trial may take long time.

Learned Public Prosecutor and counsel for the complainant have opposed the bail applications.

Considering the contentions put-forth by the counsel for the petitioners and taking into account the facts and circumstances of the case and also considering the period of custody and the fact that the co-accused-Sonu@mohit has already been released on bail and without expressing any opinion on the merits of the case, this court deems it just and proper to release the petitioners on bail.

Accordingly, these bail applications under Section 439 Cr.P.C. are allowed and it is ordered that the accused-petitioners-

Copy of the present order be separately placed in each file.
