The present bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No. 39/2019 Registered at Police Station Harmada, Jaipur for the offence(s) under Sections 376(D), 344 & 366 of I.P.C.

Counsel for the petitioner submits that the petitioner has been falsely implicated in this matter. Counsel further submits that the prosecutrix is a married lady aged about 20 years and she travelled with the petitioner to so many places without raising any alarm. Counsel further submits that the co-accusedSushil@gullaram has already been released on bail by the Coordinate Bench of this Court vide order dated 09.01.2020 passed in S.B. Criminal Misc. Bail Application No.16460/2019 and

challan has already been presented in the court and conclusion of trial may take long time.

Learned Public Prosecutor has opposed the bail application.

Considering the contentions put-forth by the counsel for the petitioner and taking into account the facts and circumstances of the case and also considering the period of custody as well as the fact that the co-accused-Sushil@gullaram has already been released on bail without expressing any opinion on the merits of the case, this court deems it just and proper to release the petitioner on bail.

Accordingly, the bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioner- Kanaram Bunkar S/o Shri Danaram Bunkar shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
