This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C. seeking regular bail in connection with F.I.R. No. 160/2019 registered with Police Station Sadar Fatehpur, District Sikar, for the offences punishable under Sections 323, 324, 307, 34 of IPC and Section 27 of Arms Act.

It has been submitted on behalf of the accused petitioner that he has been falsely implicated in this case. After investigation charge-sheet has been filed in the learned trial court. Completion of trial will take considerable time. The allegation of causing injury by fire arm is attributed to Surendra Kumar. There is no such allegation against present petitioner.

Learned Public Prosecutor has opposed the bail application and has submitted that there are nine other criminal

cases pending against the present petitioner which have been registered in different police stations for grave offences. It has also been submitted that looking to the charges levelled against the present petitioner which are under Sections 324, 326, 307, 34 of IPC and Section 27 of Arms Act, this bail application deserves to be rejected.

Heard learned counsel for the petitioner as well as learned Public Prosecutor, perused the material available on record.

On consideration of contentions put forth by both the parties, perusal of material available on record and gravity of offence and criminal antecedents of the present petitioner but without commenting upon detailed merits of the case, this court is not inclined to grant benefit of bail to the present accused petitioner. However, the petitioner may move fresh application after statements of material witnesses are recorded in the learned trial court.

Accordingly, the bail application is dismissed.
