Petitioner has filed this second bail application under Section 439 of Cr.P.C.

F.I.R. No. 47/2006 was registered at Police Station Khandela District Sikar for offence under Sections 147, 148, 149, 323, 324, 325, 307, 302, 451 & 120-B of I.P.C.

It is contended by counsel for the petitioner that petitioner has remained in custody for period of seven and a half years. All other six co-accused have been released on bail. The allegation against the petitioner is of carrying firearm. There is no gunshot injury caused to deceased. It is also contended that out of criminal antecedents pointed out, petitioner stands acquitted in 21 cases, in three cases he has completed his sentence and he is on parole.

It is further contended that 42 witnesses have been examined, except the Police witness.

Learned Public Prosecutor has opposed the second bail application. It is contended that petitioner is a gangster and has as many as 32 cases registered against him.

6. I have considered the contentions.

Considering the contentions put forth by counsel for the petitioner, I deem it proper to allow the second bail application.

This second bail application is accordingly allowed and it is directed that accused petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to
