The petitioner has filed this second bail application under Section 439 Cr.P.C. in connection with FIR No.34/2020 registered at Police Station Chandwaji, District Jaipur Rural for the offences under Sections 395, 365 & 342 IPC.

Heard learned counsel for the accused-petitioner and learned Public Prosecutor appearing for the State and carefully scanned the relevant material made available on record.

Learned counsel for accused-petitioner submits that charges have been framed against the accused-petitioner under Sections 395, 412, 201 & 120B IPC.

Learned counsel submits that accused-petitioner does not have any role in the robbery and he was arrested from the godown. Learned counsel also submits that petitioner has not been identified as identification parade was not conducted and the

allegations against the petitioner would not travel beyond Section 412 IPC.

Learned Public Prosecutor has apprised the court that accused-petitioner was not arrested in veil and therefore, there was no identification parade conducted.

Taking into consideration the aforesaid aspects that trial is likely to take time, the charges have already been framed but without expressing any opinion on the merits and demerits of the case, I am inclined to release the accused-petitioner on bail.

Therefore, this second bail application is allowed and it is directed that accused-petitioner namely, Mohit Singh @ Bablu @ Manoj S/o Shri Rajendra Singh shall be released on bail under Section 439 Cr.P.C. in connection with aforesaid FIR, provided he furnishes a personal bond in the sum of Rs.50,000/- together with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that he shall comply with all the conditions laid down under Section 437(3) Cr.P.C.
