The petitioner has been arrested in connection with FIR No.69/2020, Police Station Napasar, District Bikaner, for the offences punishable under Sections 452, 395 of IPC. He has preferred this interim bail application under Section 439 Cr.P.C.

Heard learned counsel for the petitioner as well as learned Public Prosecutor and also perused the material on record.

Learned counsel for the petitioner submits that petitioner’s grand-mother has expired on 22.06.2020 and in order to perform the last rites, the petitioner may be released on interim bail for a period of five days.

Learned Public Prosecutor has opposed the bail application.

Having regard to the totality of the facts and circumstances of the case, I deem it just and proper to grant interim bail to the

accused petitioner under Section 439 Cr.P.C. for a period of five days to perform the last rites of his grand-mother.

Accordingly, the interim bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner-Jaikishan S/o Lt. Sharwan Singh Rajpurohit shall be released on interim bail for a period of 05 days from the date of his actual release from prison and shall surrender on 08.07.2020 in the morning , in connection with FIR No.69/2020, Police Station Napasar District Bikaner, provided he furnishes a personal bond in the sum of Rs.50,000/- along with two sureties of Rs.25,000/- each to the satisfaction of the concerned Jail Superitendent on usual conditions. The petitioner shall surrender back before the concerned Jail Superitendent on 08.07.2020 in the morning . The concerned Jail Superitendent shall be at liberty to impose any other usual terms and conditions for surrender of the petitioner in prison.
