The applicant has filed this bail application under Section 439 Cr.P.C. in FIR No. 105/2020 registered at Police Station Mundawar, District Alwar for the offences under Sections 16/54, 19/54 Rajasthan Excise Act.

Heard learned counsel for both the sides and perused the material made available on record.

Learned counsel for the applicant submits that the applicant is quite innocent and he has been falsely implicated in the case. He is in jail for more than two months. He does not have any criminal antecedents. He is not required any more for investigation. Conclusion of trial will take considerable time. The bail application be allowed.

Keeping in view all the facts and circumstances of the case, but without expressing any opinion on merits, the Bail application is allowed and it is directed that the accused-applicant be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial court with the stipulation that he shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
