Petitioners have filed these bail applications under Section 439 of Cr.P.C.

F.I.R. No. 09/2020 was registered at Police Station Khairthal, District Bhiwadi, for offences under Sections 457 and 380 of IPC.

It is contended by counsel for the petitioners that petitioners were arrested in April in connection with Sections 332, 353 and 307 of IPC. Thereafter, they were made accused in the cases pertaining to theft of ATM machines. It is also contended that recovery has been effected from an open place. There is no mention in the charge-sheet that the persons who have stolen the ATM machines are the same persons who are the petitioners before this Court.

Learned Public Prosecutor has opposed these bail applications. It is contended that petitioners are having criminal antecedents of like nature.

I have considered the contentions.

Considering the contentions put forth by counsel for the petitioners, I deem it proper to allow these bail applications.

These bail applications are accordingly allowed and it is

directed that accused petitioners shall be released on bail provided they furnish a personal bond in the sum of Rs.1,00,000/- (Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to

do so.

A copy of this order be sent to concerned S.H.O. for recording this condition in the Village Crime Record Book so that in the event of petitioners’ repeating offence, S.H.O. can move the Court for cancellation of bail.
