This Criminal Misc. Bail Applications have been brought under Section 439 of Cr.P.C., seeking regular bail in connection with F.I.R. No. 145/2020 registered with Police Station Shahpura, District Jaipur for offence under Sections 342, 365, 384, 389 and 120-B IPC.

Heard learned counsel for the accused petitioners through video conferencing and perused the record.

It is contended by the petitioners that they have been falsely implicated in these cases. After thorough investigation, chargesheet has been filed under Sections 170, 171, 342, 365, 384, 389, 419, 420 and 120-B IPC. The matter is triable by Magistrate Court. Completion of trial will take time. There is no reliable evidence on record to connect accused-petitioners with the alleged crime. The only evidence on which prosecution relies is the call

details which are not reliable to connect petitioners with the offence. Co-accused Mahaveer S/o Shree Bodu Ram has been released on bail by the Co-ordinate Bench of this Court on 16.04.2020.

Learned Public Prosecutor has opposed the bail application. 5. I have considered the contentions.

On consideration of arguments/submissions of both the parties, perusal of material on record and looking to the facts and circumstances of the case, but without commenting upon detailed merits of the case, this court deems it fit to enlarge the accusedpetitioners on bail.

Therefore, the bail applications are allowed. Accusedpetitioners (1) Jasvindar @ Banti S/o Sarabjit Singh (2) Kanaram S/o Shri Sugaram (3) Basant S/o Shri Ramdas (4) Jitendra S/o Shri Moolchand and (5) Harish Kumar S/O Surajmal shall be released on bail in FIR No. 145/2020 registered at Police Station Shahpura, District Jaipur , if they are not wanted in any other case, provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/(Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court and any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
