This bail application has been filed under Section 439 Cr.P.C. in connection with FIR No.102/2020 registered at Police Station, Kotwali District Bharatpur, for offence under Section(s) 379, 427 and 448 IPC.

Learned counsel for the petitioner submits that with regard to the same incident, earlier complainant had lodged FIR No.466/2019 on 24.10.2019 for which final report was submitted by the Police against the allegations, which have been levelled making the same facts alleging that a fresh FIR has been filed. Learned counsel submits that the petitioner has been arrested and alleged recovery has been affected from him falsely. Learned counsel for the petitioner submits that charge sheet has already been filed and the petitioner is in custody for the last two and half months.

Learned Public Prosecutor has opposed the bail application. Taking into consideration the nature of the allegation levelled against the petitioner, but without commenting on merits of the case, I deem it just and proper to enlarge the petitioner on bail.

Therefore, this bail application is allowed and it is ordered that the accused-petitioner-Kuldeep S/o Shri Kunwarjeet be released on bail under Section 439 Cr.P.C. in connection with aforesaid FIR provided he furnishes a personal bond of Rs.20,000/- with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that they shall comply with all the conditions laid down under Section 437 (3) Cr.P.C.
