Petitioner has filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in F.I.R. No. 309/2019 registered at Police Station Nahargarh Road, Jaipur City (North) for offences under Sections 8/20, later on added Section 8/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 .

Learned counsel for the petitioner has submitted that the petitioner is aged about 70 years and has been falsely involved in this case on the basis of the statement of the coaccused recorded during investigation. Co-accused Santosh Kumar Bhati, from whom the contraband was recovered, has been ordered to be released on bail by Co-ordinate bench of this Court. Recovery of non-commercial quantity of contraband was effected

from the co-accused. Petitioner is not involved in any other case under the Act.

Learned State Counsel has opposed the application. Since in the present case, co-accused has been granted

bail by Co-ordinate bench of this Court, it would be just and expedient to order the release of the petitioner on bail.

Accordingly, without expressing any opinion on the merits of the case, this petition is allowed. Petitioner be admitted to bail subject to satisfaction of the Trial Court.
