Heard learned counsel for the accused-petitioners through video conferencing and learned Public Prosecutor, present in the Court.
Learned counsel for the accused-petitioners submitted that the accused-petitioners have been arrested in a case arising out of FIR No.286/2019 registered at Police Station Bansoor for the offence under Sections 332, 333 and 353 IPC and Section 3 of PDPP Act.
Learned counsel for the accused-petitioners submitted that the accused-petitioners are in custody since 12th March, 2020 and after investigation, the Police has filed challan under Sections 332,

333 and 353 IPC as well as under Section 3 of Prevention of Damage to Public Property Act, 1984.
Learned counsel submitted that nature of the allegations, levelled against the accused-petitioners, is not of that serious nature and as such learned counsel submitted that the accusedpetitioners may be enlarged on bail.
Learned counsel further submitted that the accusedpetitioners are not required for any purpose by the authorities now.
Learned Public Prosecutor has opposed the bail application.
Considering the contention raised by learned counsel for the accused-petitioner and the injury report of the injured Rajesh Kumar and the nature of allegation and injuries sustained by the injured, as well as taking into account the facts and circumstances of the case, this court deems it just and proper to enlarge the accused-petitioners on bail.
Accordingly, the present bail application under Section 439 Cr.P.C. is allowed and it is ordered that the accused-petitioners (i) Ashok Saini S/o Dindayal and (ii) Mahendra Kumar S/o Keharsingh shall be enlarged on bail provided each of them furnishes a personal bond in the sum of Rs.25,000/- with one surety of alike amount to the satisfaction of learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
