These Criminal Misc. Bail Applications have been brought

under Section 439 of Cr.P.C., seeking regular bail in connection with F.I.R. No. 239/2019 registered at Police Station Khatu Shyamji, District Sikar (Raj.) for offence under Sections 323, 365, 392, 342 & 394 R/W 34 IPC.

Heard learned counsel for the accused petitioner through video conference and perused the record.

It is contended on behalf of the accused-petitioners that they have been falsely implicated in these cases. The petitioners are not named in the FIR. There is no cogent evidence to connect them with the alleged crime. After thorough investigation, chargesheet has been filed. The petitioners are in custody since long time. Co-accused Ramniwas @ Niwas @ Banti and Vinod Kumar @ Veeru have been granted bail by the Co-ordinate Bench of this Court and the matter of the petitioners is not different from that of them. Completion of trial will take time.

Learned Public Prosecutor has opposed the bail application.

I have considered the contentions.

On consideration of arguments/submissions of both the parties, perusal of material on record and looking to the facts and circumstances of the case, but without commenting upon detailed merits of the case, this court deems it fit to enlarge the accused -petitioners on bail.

Therefore, the bail applications are allowed. Accusedpetitioners (1) Subhash S/o Sanwarmal and (2) Govindram S/o Shri Kanhaiyalal shall be released on bail in FIR No. 239/2019 registered at Police Station Khatushyamji, District Sikar , if they are not wanted in any other case, provided each of them furnishes a personal bond in the sum of Rs.50,000/(Rupees Fifty Thousand only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand only) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court and any court to which the

matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
