This bail application has been filed under Section 439 Cr.P.C. in connection with FIR No.467/2019 registered at Police Station, Dadabari, Kota, for offence under Section(s) 420, 406 IPC.

Learned counsel for the petitioner submits that the petitioner is in custody since 5.1.2020. Counsel submits that charge sheet has already been filed. The FIR was registered by one Vineeta Varshnay who was having the partnership with the father of the accused petitioner, Rajeev Varshnay and a dispute arose between partners resulting in the FIR being lodged by Vineeta Varshnay. Counsel submits that the Investigating Agency has also made Vineeta Varshnay as an accused in the present case and as regards petitioner, no recovery is required to be made from him.

Learned Public Prosecutor has opposed the bail application and submits that the petitioner also equally involved in the matter.

I have considered the submissions and finds that the case is triable by Magistrate and trial is likely to take long time and charge sheet has already been filed. It is also noticed that no money was recovered from the petitioner’s bank account.

Taking into consideration the nature of the allegation levelled against the petitioner, but without commenting on merits of the case, I deem it just and proper to enlarge the petitioner on bail. Therefore, this bail application is allowed and it is ordered that the accused-petitioner-Kunal Varshnay S/o Shri Rajeev Varshnay be released on bail under Section 439 Cr.P.C. in connection with aforesaid FIR provided he furnishes a personal bond of Rs.20,000/- with one surety in the like amount to the satisfaction of the concerned Magistrate with the stipulation that they shall comply with all the conditions laid down under Section 437 (3) Cr.P.C.
