The present bail application has been filed under Section 439 Cr.P.C. on behalf of the petitioners who are in custody in connection with F.I.R. No.286/2019, Police Station Boranada, Jodhpur, for the offences under Sections 341, 323, 325 and 326/34 of IPC.

Heard learned counsel for the petitioners, learned counsel for the complainant and learned Public Prosecutor. Perused the material available on record.

Learned counsel for the petitioners at the outset submits that he does not want to press the bail application qua the petitioner No.1 Suresh Ram as the injuries are said to have been inflicted by Suresh Ram, however, seeks liberty to file the fresh bail application after filing the charge sheet.

Accordingly the bail application qua petitioner No.1 Suresh Ram is dismissed as not pressed at this stage with liberty as prayed for.

So far as the petitioner Nos.2 and 3 are concerned, it is submitted by learned counsel for the petitioners that the allegation of attributing the injuries is against the accused Suresh Ram and the participation of the present petitioners Ridmal Ram @ Ramesh & Gopa Ram appears to be an over implication. Therefore, it is prayed that the petitioners may be enlarged on bail.

The learned Public Prosecutor as well as learned counsel for the complainant oppose the bail.

Having regard to the facts and circumstances of the case and upon a consideration of the arguments advanced, this Court is of the opinion that the bail application filed by the petitioners No. 2 and 3 deserves to be accepted.

Consequently, the bail application is allowed. It is ordered that the accused-petitioners (1) Ridmal Ram @ Ramesh S/o Narsingaram & (2) Gopa Ram S/o Sh. Prema Ram arrested in connection with F.I.R. No. 286/2019, Police Station Boranada, Jodhpur shall be released on bail; provided each of them furnishes a personal bond of Rs.50,000/- (Rupees: Fifty Thousand Only) with two sureties of Rs.25,000/- (Rupees : Twenty Five Thousand
