The petitioner has been arrested in connection with FIR No. 126/2020 of Police Station Jai Narayan Vyas Colony, Bikaner for the offences punishable under Sections 307, 323, 327, 395, 436, 450, 147, 148, 149 and 120-B of IPC. He has preferred this bail application under Section 439 Cr.P.C.

Learned counsel for the petitioner submits that the coaccused Shoiab Ahktar (vide order dated 18.09.2020 in SBCMBA No.10207/2020), Govind Singh @ Rajvir Singh @ Raju (vide order dated 18.09.2020 passed in SBCMBA No.9636/2020), Gaurav Singh (vide order dated 21.08.2020 passed in SBCMBA No.8184/2020, Bhawani Singh (vide order dated 22.07.2020 passed in SBCMBA No.7150/2020) and Niyaz Gauri (vide order dated 22.07.2020 passed in SBCMBA No.6754/2020) have already been released on bail by a coordinate Bench of this Court. It is also contended that the charge-sheet has already been filed.

Learned Public Prosecutor has opposed the bail application.

Having regard to the totality of the facts and circumstances of the case as also the fact that co-accused have already been granted bail and conclusion of the proceedings is likely to take some time and without expressing any opinion on the merits of the case, this Court deems it just and proper to grant bail to the accused petitioner under Section 439 Cr.P.C.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioner Bhawani Singh @ Haddi S/o Hari Singh shall be released on bail in connection with FIR No. 126/2020 of Police Station Jai Narayan Vyas Colony, Bikaner provided he executes a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/-

each to the satisfaction of learned trial court for his appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.

Learned counsel for the petitioner does not want to press this criminal misc. bail application, but seeks liberty for the petitioner to file fresh bail application after filing of charge-sheet.

Accordingly, this criminal misc. bail application preferred by the petitioner under Section 439 Cr.P.C. is dismissed as not pressed with the liberty as prayed for.
