In wake of onslaught of COVID-19, lawyers have been advised to refrain from coming to the Courts.

This Court perused the material available on record.

¶16

The petitioners have been arrested in FIR No.260/2020 of Police Station Kotwali, Pali for the offences punishable under Sections 143, 323, 307 IPC. They have preferred this bail application under Section 439 Cr.P.C.

Learned counsel for the petitioners submits that the petitioners are in custody since 21.07.2020 and charge sheet in this case has already been filed.

Learned Public Prosecutor has opposed the bail application.

Though there are 14 injuries and six of them are grievous but none of the injuries are dangerous to life and all the injuries are on limbs. The previous animosity, which is alleged, has not been disclosed by the prosecution or the injured witness. Though the antecedents are worrying but looking into the long time of custody and also the fact that it is COVID times, this Court deems it just and proper to grant bail to the accused petitioners under Section 439 Cr.P.C.

Accordingly, this bail application filed under Section 439 Cr.P.C. is allowed and it is directed that petitioners (1) Anish Ahmed S/o Sh. Abdul Raseed and (2) Rais @ Dilip S/o Sh. Abdul Raseed shall be released on bail in connection with FIR No.260/2020 of Police Station Kotwali, Pali provided each of them execute a personal bond in a sum of Rs.50,000/- with two sound and solvent sureties of Rs.25,000/- each to the satisfaction of learned trial court for their appearance before that court on each and every date of hearing and whenever called upon to do so till the completion of the trial.

The prosecution shall be at liberty to apply for cancellation of bail of the petitioners, in this case, if the petitioners are found to be involved in any other criminal activity within a period of one year.
