Learned counsel for the appellant/applicant has submitted that there was delay in lodging the FIR. Prosecutrix was a married lady. Appellant/Applicant was on bail, during trial. Now, appellant/applicant is in custody for the last about one year after conviction. Appellant/applicant does not have any criminal antecedents.
Learned State counsel has opposed the application.
Keeping in view the facts and circumstances of the case, it would be just and expedient to suspend the sentence of the appellant/applicant, during the pendency of the appeal.
Accordingly, application is allowed. Sentence qua imprisonment of the appellant/applicant shall remain suspended

during the pendency of the appeal. Appellant/applicant be admitted to bail subject to satisfaction of the trial Court.
