“The petitioner by way of this writ petition prayed for payment of the amount as collected from the petitioner @10% of the remuneration under the head of Welfare in last 27 years of service as Home Guard in the Department, and also prays for 9% interest. Counsel for the petitioner has taken to this court to the circular issued by Civil Defence and Home Guard Head Quarter, Rajasthan, Jaipur dated 6.5.2013 and pointed out that the appointing agency who obtained the duties of Volunteers would have to deposit 10% in the Department Welfare Fund. He has also taken to this court to the circular dated 8.5.2017 issued by the Director General, Home Guard, Rajasthan, jaipur wherein the said aspect has been reiterated for being depositing the fund with the Home Guard Welfare Fund which has been created for providing facilities to the Volunteers on account of any injury or unnatural death caused to the Volunteers. On perusal of the said circulars, I find that the circulars speak of payment of amount by the concerned agencies to the Home Guard Welfare Fund. The amount so deposited in the Home Guard Welfare Fund be released to the Volunteers who suffered any illness during service or suffered any injuries on account of any accident and also volunteers dies while on duty, the payment has to be made to the family members. There is no provision to release the amount so deposited by the individual volunteers at the time of his retirement. The circulars dated 8.5.17 and 6.5.13 are not under challenge. The petitioner has already been retired and during service he has never claimed the said amount.
