his footwear. The learned Single Judge took note of a report by the Commissioner charged with examining the photograph prepared by the State. The comments of the Commissioner so far as the present petitioner /appellant are concerned as follows:
“Only the start/finish of the track is visible in the video. The videography reveals slight patches of wetness on matting (laid for the purposes of monitoring the time of candidates) at the beginning of the run, which dries as the run progresses. Though it is difficult to extrapolate the condition of the entire track but on the face of it, the condition of track looks dry & firm.”
