Shafi Mohd. Mehar Vs State of Rajasthan

Learned Senior Counsel Mr.G.R.Punia submits that an application under Order 1 Rule 10 CPC for impleadment of the appellants has already been filed before the Single Bench and the same is pending consideration. The appellants are aggrieved by the interim order passed by the learned Single Judge.

At this stage, entertaining any kind of litigation, especially when the appellants are not party in the writ petition and their application under Order 1 Rule 10 CPC is pending consideration, would not be appropriate. Hence, while dismissing the appeal, this Court deems it appropriate to request the learned Single Judge to decide the application under Order 1 Rule 10 CPC expeditiously preferably within ten days from today. We order accordingly.

It is made clear that the issues raised in this appeal are kept open for adjudication as and when a fresh appeal is filed if

occasion arises, for which liberty, as prayed for, is granted to the learned counsel for the appellants.

The appeal is dismissed with the aforesaid liberty.
