By way of this writ petition (PIL), the petitioners are seeking directions to the respondents for sanction of Sub Health Centre at Village-Berasar.

Reply to the writ petition has been filed on behalf of the respondent No.6-Sarpanch Gram Panchayat, Pindiya as also on behalf of the respondent-State.

As per the resolution adopted by the Gram Panchayat, Pindiya in its meeting held on 05.11.2017, the establishment of Sub Health Centre is proposed on the land measuring 0.16 biswas comprising Khasra No.140, alleged to have been encroached upon by unscrupulous elements. However, as per the reply of the State, the land measuring 5 biswas comprising Khasra No. 495/330 has already been allotted for establishment of Sub Health Centre at Village-Beraser. But the fact remains that even after lapse of more than six years since the allotment of the land, no steps whatsoever have been taken by the State for establishing the Sub Health Centre at Village-Beraser.

In this view of the matter, the writ petition is disposed of with the directions that the dispute, if any regarding the location of the Sub Health Centre at Village-Beraser, shall be resolved by the State Government within a period of one month from the date of this order. The necessary budget for the establishing the Sub Health Centre at Village-Beraser, shall be sanctioned within a period of one month thereafter and the constructions of the Sub Health Centre at the appropriate place, shall be completed within a period of six months thereafter.

After completion of work within stipulated time frame as aforesaid, the compliance report shall be filed by the respondents before this Court.
