Application no.1/19 has been moved by the respondent stating that while the present writ petition assails the order passed under Order 14 Rule 5 C.P.C., the main suit itself has been disposed on the basis of a compromise arrived at between the parties.
Learned counsel for the petitioner states that he does not have any instructions.
Taking the statement of learned counsel for the respondent at Bar as correct, this writ petition is dismissed as infructuous with liberty to the petitioner to revive the same if facts are found to be otherwise.
