Upon being asked whether any application has been moved by the petitioner before the competent authority under Rule 13(5) of the Rules of 1958 for revoking his suspension, counsel submits that no such application has been moved although there is a letter written by the department whereby they want the petitioner to be reinstated. He submits that petitioner was suspended on having remained in judicial custody for a period of more than 48 hours although there is no case made out against him. Counsel thus prays to allow him to withdraw this writ petition with liberty to the petitioner to file representation and to invoke the remedy available under Rule 13(5) of the Rules of 1958.
Having considered the submissions, the liberty is granted.
The writ petition is accordingly dismissed as withdrawn with liberty as prayed for.
