The present misc. petition has been filed by the petitioner against the order dated 10.6.2019 by which the Chief Judicial Magistrate, Sikar rejected the application filed by the petitioner under Section 70(2) Cr.P.C. for converting arrest warrant into bailable warrant.

Counsel for the petitioner submits that the compromise has been arrived between the parties and all the co-accused have already been acquitted by the trial Court. So in these circumstances, the arrest warrant so issued to the petitioner may be converted into bailable warrant and he also assures to this Court that in future petitioner will attend each and every date before the trial Court.

Learned Public Prosecutor opposed the prayer made by the petitioner.

I have considered the arguments advanced by the learned counsel before me.

Looking to the fact that co-accused have already been acquitted by the trial Court and compromise has taken place between the parties. In these circumstance and in the interest of justice, it is directed that petitioner may appear before the trial Court on or before 23.9.2019 and on submission of bail bond of Rs.50,000/- by the petitioner, trial Court shall release him on bail. If the petitioner will not surrender on or before 23.9.2019, the trial Court shall issue arrest warrant against him.

Till 23.9.2019, petitioner shall not be arrested in pursuance of Criminal Misc. Case No.694/2010 before the Court of Chief Judicial Magistrate, Sikar.

The criminal misc. petition accordingly stands disposed of. Since the main petition is disposed of, stay application also stands disposed of.
