Petitioners have preferred this Criminal Misc. Petition under Section 482 Cr.P.C. seeking quashing of FIR No.669/2008,

registered at Police Station Gangapur City, District Sawai Madhopur and Criminal Case No.65/2014, pending before the Additional Civil Judge-Cum- Judicial Magistrate No.1, Gangapur City, District Sawai Madhopur for offence under Sections 458, 336 IPC.

It is contended by counsel for the petitioners that the parties have amicably settled the dispute. A compromise deed was filed before the Court below. Court below has compounded the offence under Sections 323/34 as 325/34 is non-compoundable, the same was not compounded.

Victim-complainant alongwith her counsel is present in person in the Court, who has not disputed the fact of parties having amicably settled the dispute and has no objection to the quashing of the proceedings pending before the Court below.

I have considered the contentions.

In view of the fact that parties have amicably settled the dispute and victim complainant has no objection to the quashing of the proceedings pending before the Court below, the Criminal Misc. Petition is allowed. Offence under Sections 323/34 and 325/34 is compounded. Proceedings pending before the Court below are quashed. Stay application stands disposed.
