Learned counsel for the partie< agree that the matter is
squarely covered by the judgment passed by this Court in Neki
Ram Vs. State of Rajasthan (s.B. Criminal Misc. petition
No.86/2019) decided on 08.01.2019. The said judgment reads
as under :-
"The petitioners have preferred this petition claiming follo wing reliefs: -
"It is, therefore, most humbly and respectfully
prayed that this misc. petition may kindly be allowed
and impugned FIR No. 107/2014 Police Station Anti
Corruption Bureau, Jaipur (ACB Chowki Hanumangar)

The facts of the case are that the Chief Executive,
Zila Parishad, Hanumangarh submitted a complaint before

petitioners were the same persons who were defendant.
He further submits that the petitioners have nothing to do
with the illegal allotment, He further submits that the
amount in question has been deposited which may also be
considered.
Learned counsel for the petitioner submits that the
petitioner wants to submit a representation alongwith all
the relevant documents before the concerned investigating
authority to redress the issue.

Learned Public Prosecutor assures this Court that if the petitioner submits a representation along with all the necessary documents before the concerned investigating authority within a period of ten days from today, then the same shall be considered and decided strictly in accordance with law, before completing the investigation. Learned counsel also takes note of the fact as informed by the learned counsel for the petitioner that the
criminal misc. petition of the Sarpanch has already been dismissed by this Hon'ble Court. However the same shall not impact upon the present controversy but the Sarpanch has a direct role in the execution of patta and was not a authority which may or may not abuse."
