The matter was placed before the Lok Adalat today.
Present appeal under Section 173 of the Motor Vehicles Act, 1988 is preferred by the claimant-appellant(s) seeking enhancement of compensation quantified and awarded by Motor Accident Claims Tribunal, Chittorgarh, vide its judgment & award dated 23.02.2007 in Claim Case No.478/2004.
Pending instant appeal, appellant(s) and respondent Insurance Company made sincere endeavour to resolve the dispute by mutual agreement. After threadbare deliberations, rival parties, in the spirit of Lok Adalat, have agreed to settle the matter perpetually.
In terms of settlement, respondent insurer has agreed to pay appellant(s) lump sum additional amount of compensation to the tune of Rs.55,000/- inclusive of interest, within two months from today. The insurer has further agreed to pay interest @9% per annum on the
enhanced amount of compensation from the date of filing of the appeal in the event of its failure to pay the requisite amou,nt within stipulated period of two months.
Accordingly, the instant appeal is disposed of in terms of the compromise arrived at in the spirit of Lok Adalat.
The Registry is directed to send back the record forthwith, if received.
