Heard the learned counsel for the petitioner’s friend as well as the learned Public Prosecutor and perused the material available on record.

The petitioner has been arrested in FIR No. 44/2018 of Police Station Savina, District Udaipur for the offences punishable under Sections 302, 120-B IPC. He has preferred this interim bail application under Section 439 Cr.P.C.

This interim bail application is preferred on behalf of the petitioner with a prayer to release him on interim bail till 07.08.2019 on account of death of his father. It is noticed that the Additional Sessions Judge No.4, Udaipur had already directed the Jail Authorities to allow the petitioner to attend the funeral of his father on 22.07.2019 and thereafter to attend the Tesere ki Dhoop on 24.07.2019 under police protection. Nitesh Bairagi, petitioner’s friend present in person, that for the purpose for attending the 12^th day ceremony, the petitioner may be granted interim bail up to 7.8.2019.

Having considered the facts and circumstances of the case, I do not find any case to release the petitioner on interim bail till 7.8.2019 because the petitioner had already been allowed to attend the funeral of his father and other rituals for two days under police protection by the trial court. However, if the petitioner is required to perform some rituals on 12^th day ceremony, it is open for him to approach the court below for the purpose of attending the said ceremony for one day under police protection.

Accordingly, the interim bail application preferred by the petitioner under Section 439 Cr.P.C. is rejected.
